Representative Experience

James C. McCann’s practice encompasses the areas of acquisition, sale, development of real property, land use, redevelopment law, tax abatements, condominium and planned real estate development law, and alcoholic   beverage licensing, transfers and regulatory     compliance.

 

Mr. McCann has been a real estate practitioner in Jersey City for 18 years, handling complex land use and permitting matters. He specializes in the representation of developers before municipalities, redevelopment agencies and planning boards in redevelopment areas established under New Jersey’s Local Redevelopment   and Housing Law and in the negotiation of tax abatement agreements with municipalities under New Jersey’s Long Term Tax Exemption Law and other tax abatement statutes. Mr. McCann has assisted in the drafting of numerous redevelopment plans and through his representation of the development community, has influenced redevelopment and tax abatement policy in Jersey City. 

 

His experience extends to the representation of developers in the New Jersey Superior Court, Law Division, Chancery Division and Appellate Division on litigated approvals under the Municipal Land Use Law, Local Redevelopment and Housing Law, and New Jersey’s Long Term Exemption Law. Mr. McCann has prepared and registered numerous applications for registration of public offering statements with the New Jersey Department of Community Affairs in condominium conversions and the establishment of condominium ownership for mixed-use and high-rise buildings. He has extensive experience representing developers and restaurateurs in alcoholic beverage licensing, liquor license transfers, and regulatory compliance.

 

Representative clients range from large nationally known development companies to small and medium sized real estate developers, many of whom have developed notable projects contributing to the real estate renaissance which has occurred in Jersey City. He has also served as general counsel to a major municipal utilities authority in New Jersey.

 

Mr. McCann has lectured for the New Jersey Institute for Continuing Legal Education and the New Jersey State Bar Association on the Long Term Tax Exemption Law and the Local Redevelopment and Housing Law.

General development counsel to the Lefrak Organization in connection with “Newport” ─ a 600-acre master planned, mixed-use community located on the Hudson River waterfront in Jersey City, New Jersey, currently consisting of nine high-rise rental apartment buildings, three high-rise condominium buildings, eight high-rise office towers, two hotels, and thousands of square feet of retail, office and entertainment facilities;

General development counsel to Toll Bros, Inc. in connection with 700 Grove, a 230 unit high-rise luxury residential condominium and 10 Provost Square, a planned high-rise mixed-use condominium with up to 900 residential units, 50,000 square feet of retail space and a performing arts center in Jersey City’s Powerhouse Arts Redevelopment District;

General development counsel to SK Properties in connection with: Grove Pointe Master Condominium, a luxury mixed-use high-rise complex with 458 residential rental units, 67 residential condominium units and retail space; Grand Liberty Harbor North I, a planned 330 unit residential high-rise building; Grand Liberty Harbor North II, a planned 500 unit residential high-rise apartment building;

General development counsel to COALCO New York in connection with the renovation and adaptive re-use of Jersey City’s former American Can building to establish a 551-unit, residential loft condominium complex with 25,000 square feet of retail space;

General development counsel for “Liberty Harbor,” an 80-acre master planned mixed-use community in Jersey City currently consisting of 279 residential town home-style and high-rise condominiums, 353 residential rental units in two high-rises, with retail, office and entertainment facilities;

General development counsel to Fisher Development Associates, LLC in connection with Liberty Towers, a two tower 648 unit residential rental complex; Liberty Terrace a 119 unit residential condominium; and Crystal Point, a planned 269 unit luxury high-rise residential condominium, all located on Jersey City’s Hudson River waterfront;

General development counsel to Fields Development Group in connection with Waldo Lofts, a luxury high-rise condominium containing 82 residential lofts and 10,000 square feet of retail space located adjacent to Jersey City’s Powerhouse Arts Redevelopment District;

General development counsel to Roseland Properties, Inc. and Garden State Developers, Inc. in connection with the development of 455 Washington Boulevard Master Condominium, a planned high-rise, residential rental apartment and condominium complex with 746 units;

Tax abatement counsel for Panepinto Properties, Inc. in connection with the 100 Columbus Master Condominium, a planned four tower, mixed-use high-rise rental complex with 1,267 units, a 144-room hotel, retail and office space;
