Recoverability of stimulus monies expended by USEPA in site remediations
A federal court has denied EPA’s request to maintain as confidential e-mail correspondence allegedly indicating that site remediation actvity and EPA costs were driven not by an immediate threat to the environment or other emergency but instead by redevelopment goals. Such challenges are important to issues of the recoverability of American Recovery and Reinvestment Act and other stimulus monies by USEPA from responsible parties. See USA v Sensient Colors, Inc., United States District Court for the District of New Jersey, Docket No. 07-1275.
