Lighari Obtain Dismissal of Virtual Studios' Claims
Roseland,
N.J./February 4, 2011
--- Connell Foley partner
Marc D. Haefner
and
Rukhsanah Lighari
were successful in obtaining a partial dismissal of a
claim brought by Virtual Studios against Nourison Industries
-- a major retailer of rugs. Virtual Studios claimed
that certain electronically-generated backgrounds to it
created for the display and advertising of Nourison's rugs
were improperly used by Nourison after the time for such
usage had expired. The dismissal of portions of
Virtual Studios' claims for copyright infringement, breach
of contract, and unjust enrichment, narrowed the case and
ultimately helped force the matter to a quick resolution.
The opinion explains the complex interaction between the
causes of action improperly asserted by Virtual Studios.
