Lyons to Speak on Paid Family Leave Act at NJBIA

“Paid Family Leave” Seminar on March 6, 2009. Mr.
Lyons is scheduled to speak for a second time on
March 18, 2008, from
8:30 -
1:00 p.m.,
at the Sheraton Eatontown, NJ. Mr. Lyons will
speak about how New Jersey’s paid family leave works
with unpaid leave under the Federal Family and
Medical Leave Act (FMLA) and New Jersey’s Family
Medical Leave Act (NJFLA).
Mr. Lyons’ presentation to NJBIA members explained
that while qualifying leave under any of one these
statutes can and generally should be run
concurrently with other qualifying leave, the Paid
Family Leave Act only provides partial income
replacement, and does not provide job protection or
restoration rights. An employee can be let go while
on paid leave without violating that statute. In
such circumstances, however, the job protection
provisions of the FMLA or NJFLA still apply, and an
employee may be entitled to job protection or job
restoration under those statutes. Mr. Lyons also
warned that even small private employers not subject
to the FMLA or NJFLA should still be aware that
termination decisions made during a paid leave can
be challenged as discriminatory or retaliatory under
anti-discrimination laws such a New Jersey’s Law
against Discrimination (NJLAD) and the Americans
With Disabilities Act (ADA).
