Cromie, Fleder, Smith and Shadiack Present at
AGC’s Legal Issues Seminar

Michael A. Shadiack presented at AGC of NJ &
NJAPA “2009 Legal Issues” Seminar on June 9, 2009 in
Edison, New Jersey. The seminar’s luncheon speaker
was Rick Hammer, New Jersey Department of
Transportation’s Assistant Commissioner, who
discussed the status of the current Stimulus
Program.
Mr. Cromie spoke on the new False Claims Act and its
impact on contractors performing New Jersey State
work. John D. Cromie is Chairman of the firm’s
Corporate Law and Transactions group and is a
member of the
Construction Law group. He regularly counsels
construction clients on business law issues.
Mr. Fleder discussed current bid issues affecting
the New Jersey construction industry on all fronts.
Discussed at length were wholesale rejection of all
bids by owners and recurring bid submission errors
made by contractors. Mr. Fleder also noted, with
examples, the errors contained within bid forms and
the detailed plans and specifications leading the
team to a variety of legal problems.
Mark L. Fleder is the Co-Chair of the firm’s
Construction Law
group and a member of the
Business Litigation practice group.
Mr. Smith
addressed the recent changes to the EJCDC, AIA and
Consensus construction documents and compared the
different provisions set forth in them for
presentation of contractor claims due to differing
site conditions.
Peter J. Smith is Co-Chair of the firm’s
Construction Law group and a member of the
Alternative Dispute Resolution group.
Mr. Shadiack
provided practical compliance advice on: New Jersey
Paid Family Leave Law; Lily Ledbetter Fair Pay Act;
Employee Free Choice Act; the new regulations
under the Family and Medical Leave
Act; Americans with Disabilities Act
Amendments Act of 2008; the new federal immigration
compliance procedures;
and the COBRA subsidies under the American Recovery
and Reinvestment Act of 2009. Mr. Shadiack is a
member of the
Labor and Employment Law group.
For the past 30 years, the firm has served as
general counsel to the Associated General
Contractors of New Jersey.
The Associated General Contractors of New Jersey is
a statewide association of general and specialty
contractors involved in heavy and highway
construction, site development and utility
contracting on public and private projects. It is
