Neil Mody Discusses Coverage Litigation Issues
Arising from Catastrophic Events

Neil V. Mody
presented on the topic of "Adjusting Catastrophic Losses" at
the 2011 PLRB/LIRB Large Loss Conference on September 24-26,
2011, in Chicago, Illinois. Working
with a professionally diverse
panel, including an insurance claim manager, a defense trial
attorney and an expert consulting witness, Mody outlined
strategies for handling and litigating complex insurance
coverage issues arising from various large-scale
catastrophes. The annual Large Loss Conference was
attended by approximately 1,000 insurance industry
professionals from various jurisdictions around the U.S. and
abroad.
The two-hour interactive
sessions featured spirited question-and-answer sessions
involving novel and emerging topics, including recent
developments impacting advance payment "insurance funds" for
catastrophic claims; calculating the number of occurrences
under different judicially recognized tests; dealing
with additional insured disputes
and multiple coverage layers; purported "stipulated
exhaustion" agreements; good faith obligations among
insurers; recent coverage rulings and trends; and strategies
for coverage adjudication through mediation, arbitration
and/or trial.
Mody is a Partner in Connell Foley's
Insurance Coverage Practice Group. His practice is
focused on litigation, counseling and excess monitoring on
behalf of domestic and internationally-based insurers in
various coverage matters, including property, general
liability, excess liability, professional risk and long-tail
claims, as well as bad faith, reinsurance and catastrophic
loss.
