Jennifer C. Critchley



Jennifer Critchley is a commercial litigator with substantial experience representing corporate clients in complex business disputes. Often working closely with companies — particularly emerging businesses — as an outside general counsel, she advises on a range of legal issues, from reviewing contracts and registering trademarks, to real estate transactions and intellectual property disputes. Clients value Jennifer’s responsiveness and pragmatic approach to solving their legal problems while protecting their bottom line.

With experience in both federal and New Jersey and New York state courts, Jennifer has successfully represented large corporations as well as smaller businesses in commercial litigations involving contract disputes, construction claims, unfair competition and trade libel. Her extensive and diverse work on fraud disputes includes representation of: a national bank in numerous check fraud litigations; a major entertainment company in a fraud class action involving New Jersey’s Consumer Fraud Act and its Truth-in-Consumer Contract, Warranty and Notice Act; and a multinational chemical products and services company in a patent infringement case. Jennifer also represents insurance companies in personal injury claims, and professional, product and corporate liability matters.

Regarding special education law, Jennifer is part of the team of Connell Foley lawyers committed to assisting parents as they grapple with issues like eligibility, evaluations and the preparation of Individualized Education Plans (IEPs). Jennifer and her colleagues also represent parents in mediations and litigation before the Office of Administrative Law and in federal and state courts.

Jennifer is deeply committed to community service. As Chair of Connell Foley’s Pro Bono Committee, she is responsible for overseeing the firm’s pro bono activities. She has advised several Newark-based nonprofits, including those dedicated to helping families, fostering the arts community and serving young adults. Representative Experience

  • Represented a pharmaceutical company in a six-year-long complex breach of contract dispute with a vendor for marketing services that resulted in a successful settlement
  • Successfully served as local counsel to several large pharmaceutical companies in patent infringement cases pending in the District of New Jersey
  • Defended insureds in approximately 100 personal injury defense cases on behalf of several different insurance carriers
  • Successfully defended property developer in claims brought under the Americans with Disabilities Act by serial plaintiff
  • Represented business owner in a dispute over an internet domain name resulting in litigation brought under the Anticybersquatting Consumer Protection Act (ACPA)
  • Representation of insurers and insureds in construction defect claims
  • Represented a chemical manufacturer in disputes regarding multiple complex long term contracts
  • Represented financial institutions in over 150 disputes involving unauthorized transaction litigations filed in New Jersey federal and state court
  • Part of a team of Connell Foley lawyers who serve as outside general counsel to a highly regarded university
  • Represented a subcontractor in a dispute involving the Tosco Bayway Refinery Polypropylene Plant Project
  • Part of a team of Connell Foley lawyers who obtained a successful settlement on behalf of a manufacturer in complex commercial litigation that included such issues as wrongful termination of exclusive distributorship agreement, trademark infringement, breach of contract, breach of fiduciary duties, tortious interference, defamation/trade libel and violations of the Lanham Act
