Overview

Neil Mody represents insurance companies in complex insurance coverage matters, devoting personal attention to his clients' needs and the unique circumstances of each exposure to achieve favorable results. His clients include some of the world's largest and most sophisticated insurers, as well as emerging companies offering surplus and specialty insurance products.

Neil’s experience includes hundreds of notable insurer no-cause judgments, dispositive rulings and successful resolutions across a broad range of insurance coverage disputes. He has nearly 18 years of insurance law experience encompassing the full spectrum of insurance lines: personal, property, casualty, excess, marine, contractors, environmental, reinsurance, and specialty and professional risk including D&O, E&O, EPL, cyber, tech and management liability issues. He is also frequently sought by clients for thought leadership and counseling related to complicated or unsettled legal principles in insurance coverage.

Before joining Connell Foley's Insurance Coverage Practice Group in 2003, he completed a judicial internship with the Honorable Katharine S. Hayden in United States District Court for the District of New Jersey.

  • Appointed special coverage counsel to major insurers in connection with catastrophic weather-related claims
  • Served as lead trial counsel to multiple insurers in numerous lawsuits arising from Superstorm Sandy and other weather events in New York and New Jersey
  • Conducts insurance fraud investigations on behalf of insurers in coordination with Special Investigation Units (SIU) and the Department of Banking and Insurance (DOBI)
  • Achieved a favorable first impression ruling arising from a highly publicized carjacking and wrongful death case at the Mall at Short Hills, permitting insurer client to exhaust its policy limit to resolve all claims against its named insured, even where claims against additional insured under insurer’s policy were not resolved.
  • Represents insurers in significant asbestos coverage actions involving hundreds of thousands of underlying claims and excess of $1 billion in alleged asbestos exposures
  • Achieved dispositive ruling based on application of South Carolina pollution exclusion law related to approximately $40 million in environmental liabilities
  • Secured no-cause ruling for property insurer in bad faith action based on application of “first-to-settle rule” following insurer’s resolution of more than $7.5 million in fire loss-related claims
  • Represented marine insurer in complex multijurisdictional coverage dispute arising from alleged sinking of $1.7 million private sea vessel
  • Achieved dispositive ruling dismissing policyholders' high exposure, toxic bodily injury coverage claims in New York Supreme Court
