Connell Foley Defense Team Prevails in TCPA Class Certification Case

In an article by Law.com, A Delaware federal court has denied a motion for class certification in a Telephone Consumer Protection Act case, citing both a lack of predominant issues between the claimants and the class representatives' criminal and bankruptcy histories.

With this lack of class certification, the amount of potential financial damages to be recouped by plaintiffs drops significantly, as individual claims of TCPA violation, valued at $500 per instance, would then be the only legal recourse available.

Lead counsel Leo J. Hurley Jr. of Connell Foley in Jersey City, representing defendants Northcoast and Amtrust in this matter, commended the court's recommendation, stating, "We are quite pleased with the court's decision.
