Appellate Victory Secures Sewer Service for Oakland Affordable Housing Project

Kevin Coakley and Herschel Rose were successful in appealing a decision of the New Jersey Department of Environmental Protection pertaining to the provision of sewer service for a 204-unit affordable housing project located in the Borough of Oakland in the New Jersey Highlands Region. This decision of the Appellate Division was issued after a years-long dispute between Bi-County Development Corporation and the Department, culminating in this per curiam decision issued on July 7, 2025. Connell Foley successfully defended Bi-County Development Corporation from the Department’s attempt to reduce sewer service on the subject property, which would have made the planned development practically impossible. As a result of this decision, Bi-County will be able to develop its property as an affordable housing development with adequate sewer service.
