Connell Foley’s Chair of the Labor and Employment Practice Group, Michael A. Shadiack, was recently featured as a panelist in New Jersey Business Magazine’s ongoing Business Roundtable Series. The publication invited employment law attorneys to weigh in on trending workplace issues.

When asked about employee vetting during the hiring process, Shadiack emphasized that maintaining centralized I-9 form files helps reduce security risks and grants employers quick access to important documents, which are especially crucial should an ICE officer come to a place of business. He also outlined employee and employer rights in the event of an ICE visit, reminding employers that agents may not enter private areas of the business without the employer’s permission or a judicial warrant. He advised employers to carefully review this documentation before proceeding.

As a trusted advisor on proactive and preventative counseling on new legislation, Shadiack also addressed new state pay transparency laws. He noted that one common concern from employers is the potential conflict between state and local regulations, such as Jersey City’s more stringent requirements, which are not superseded by state law.
