Taraschi and Iannaccone Secure Summary Judgment on $1.4M Suit Against NJ Company

Connell Foley LLP partners Mitchell Taraschi and Lauren Iannaccone successfully prevailed on summary judgment before the Superior Court of New Jersey, Bergen County in a high stakes lawsuit against their client, a New Jersey based garment distributor.

The suit alleged that Lauren’s and Mitchell’s client had purchased and did not pay for approximately $1.4 million in goods; it also alleged that our client had a contract with a Hong Kong based wholesale clothing manufacturer and distributor.

Citing—among other things—plaintiff’s failure to produce purchase orders signed by our client, the Superior Court held that the defendant had no contract with plaintiff, and also that plaintiff was not a third-party beneficiary of a contract that defendant had with a non-party.

The suit is an example of the complex commercial matters that Lauren and Mitchell handle regularly.
