Overview

Connell Foley LLP's Trust, Estate, and Fiduciary Litigation Team skillfully and aggressively protects the interests of clients involved in disputes over private wealth, including will and trust contests, as well as claims arising out of alleged:

  • mismanagement, or negligent or wrongful distribution of an estate’s assets by a fiduciary (e.g., the executor of a will; a trustee, guardian, or conservator; an estate’s administrator);
  • mismanagement of investments;
  • misuse of Power of Attorney during a decedent’s lifetime;
  • mismanagement of a family-owned business;
  • incapacity of an estate’s testator or fiduciary; and
  • exertion of undue influence over a testator.

Providing a holistic approach to the representation of clients in estate-related disputes, the Trust, Estate, and Fiduciary Litigation Team works in collaboration with the firm’s adroit group of litigators and its renowned Real Estate, Corporate, and Alternative Dispute Resolution Groups.

And—on every matter—the Trust, Estate, and Fiduciary Litigation Team draws upon the in-depth knowledge of Connell Foley’s overall Taxation and Estate Planning Group, chaired by the nationally recognized tax and estate planning attorney Anthony F. Vitiello. Clients can rest assured that their trust- or estate-related controversy is in capable hands, given the Group’s extensive experience in contested matters, as well as disputes involving estate or trust accountings, the interpretation of wills and trusts, the best practices related to the execution of fiduciary duties, and the management of trusts and charitable assets.
