Construction Group Co-Chair Mitch Taraschi and Mark Fleder successfully secured summary judgment in a contentious case brought by a homeowner against Essex County. The homeowner claimed that the County's culvert was inadequate for managing water flow and sought to have it redesigned and reconstructed. If the plaintiff had prevailed, it could have set a precedent allowing homeowners to sue the government to make improvements related to issues like climate change, matters that typically fall within the government's discretion to address or ignore. This could have resulted in over $300 million in required improvements to culverts within Essex County alone.
