Taraschi and Gacos Author Article on Federal Preemption of Bans on Children's Products

Mitchell Taraschi, Chair of Connell Foley's Product Liability and Tort Law Group, and Alexander Gacos, an Associate in the Group, authored the article “Federal Preemption of State Efforts to Ban Products or Chemicals in Children’s Products” for the April edition of For The Defense, a publication of the Defense Research Institute (DRI).

While federal preemption historically served to calm the potential chaos of regulating consumer products at the state level, recently states have attempted to ban certain consumer goods, including children’s products, as well as certain chemicals used in various products. In their article, Mitch and Alexander explain how, despite these new state consumer protection laws, the precedent of preemption holds.
