Lee and Iannaccone Author Article on Anti-Assignment Clauses in ERISA Lawsuits

Patricia Lee, a partner in Connell Foley’s Health Care/ERISA Litigation Group, and Lauren Iannaccone, an associate in the Group, authored the article “ERISA Health Benefit Plans: Anti-Assignment Clauses as the First Line of Defense to Provider Lawsuits” for the June 20, 2016 issue of the New Jersey Law Journal.  The article examines the rise in ERISA lawsuits and recent guidance from the Third Circuit that provider-assignees with a right of direct payment may obtain standing to sue for that payment under ERISA.  Please see attached for full article.
