Robert Ryan, Chair of Connell Foley’s Professional Liability Practice Group, Co-Chair of the firm's Trial Practice Group and a six time Certified Civil Trial Attorney, presents a Continuing Legal Education (CLE) program that will outline the substantive law of legal malpractice causes of action in New Jersey in 2019.
Bob will cover topics including:
- the personal and professional impact of legal malpractice claims on attorneys
- the elements of a cause of action for legal malpractice, including duty and applicable standard of legal practice, breach of duty, proximate cause and recoverable damages
- factors establishing applicable standard of practice, including the Rules of Professional Conduct
- the standing of clients and non-clients to initiate legal malpractice claims
- the import of retainer agreements
- the role of expert witnesses in legal malpractice litigation
- relevant statutes and case law in legal malpractice litigation, including the Statute of Limitations, the Affidavit of Merit Act, and the Saffer line of decisions permitting prevailing plaintiff counsel fees as a component of recoverable damages in legal malpractice actions
- past efforts to modify the Statute of Limitations and Saffer doctrine by legislation
- best practices regarding professional liability insurance reporting
- risk management practices to protect attorneys from legal malpractice claims
