CLE Program: Attorney Ethics in Environmental Law Matters

Steven Barnett, partner at Connell Foley LLP, will present a CLE program titled, “Attorney Ethics in Environmental Law Matters,” on Wednesday, October 18, 2018.  The 60-minute seminar will be held beginning at 12:00 PM in AIG’s New York office.

The presentation will cover the lawyer client relationship in environmental cases. It will address the attorney client privilege and work product privilege generally; audit and self-critical analysis privilege; lawyer obligations to inform clients of frivolous claims, opposing precedent to claims; contingent fee agreements in environmental tort actions; legal ethics in review and submissions of forms, reports, certifications to regulatory authorities; and lawyer’s ethical obligations to report threats to public health and the environment.  

Often environmental lawyers work with environmental consultants and we will define the work product privilege and attorney client privileges that apply to the consultants work.  We will discuss rules applicable to defense counsel meeting, communicating with claimants considering bringing a case before it is filed.  The program will analyze conflicts rules of representing multiple parties when a cleanup site or toxic tort case involves multiple potentially responsible parties or defendants.  And we will address ethical issues in use of cloud computing, crowd sourcing, and other technologies such as remote monitoring of environmental compliance.
