CLE Program: Estate/Trust Litigation in the State of New Jersey

Gail Goldfarb, Of Counsel, will be presenting the CLE course, "Estate/Trust Litigation in the State of New Jersey." This 60 minute seminar will first discuss Estate and/or Trust Litigation in the New Jersey Chancery Court, either the Probate Part or the General Equity Part. All such litigation shall be commenced as a summary proceeding by way of an Order to Show Cause and Verified Complaint, including discussion of the relevant court rules. 

The course will then touch upon the various equitable proceedings possible in estate and/or trust litigation, such as Will (or Trust) Contests, actions by or against Agents under a Power of Attorney, actions contesting inter vivos transfers and/or disputed gifts and accounting actions by either a fiduciary or a beneficiary.  It will also cover various actions that may be commenced under each type of the litigation above-mentioned including the elements of each type of litigation and the burdens of proof.  Court cases pertinent to the discussions will be used as examples of the elements of various actions.

Finally, payment of attorney's fees in such actions will be addressed.

** This program is pending approval by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 1.2 hours of total CLE credit. Of these, 0.0 qualify as hours of credit for Ethics/Professionalism. This CLE program has been approved by the Pennsylvania Continuing Legal Education Board for 1.0 Substantive credits. **
