District Court of New Jersey Grants Motion to Dismiss Filed By Connell Foley Attorneys Andrew Sayles and Steven Kroll

In response to a suit alleging, inter alia, claims under the Fair Debt Collection Practices Act stemming from a state court foreclosure, District Judge Faith Hochberg granted Connell Foley’s Motion to Dismiss pursuant to FRCP 12(b)(1) and 12(b)(6).  In a detailed written opinion, the Court dismissed the Complaint on multiple independent grounds finding that Plaintiff’s claims were barred under the Rooker-Feldman Doctrine and by principles of res judicata.  The Court further agreed that the Complaint failed to plead any actionable claim under the FDCPA.
