A recent SCOTUS opinion resolves a split among Circuit Courts of Appeals as to whether Congress abrogated Indian tribes’ sovereign immunity in bankruptcy proceedings. While the key issue is itself of national importance, this decision will likely be referenced for matters beyond its central holding given its competing dissertations on statutory interpretation and the majority’s robust construction of the Bankruptcy Code.
