Overview
Dale E. Barney focuses his practice on all aspects of debtor/creditor relations, bankruptcy, and insolvency litigation. With substantial trial and appellate experience, he is a key member of Connell Foley’s Bankruptcy Litigation team, offering clients practical alternatives to litigation through mediation and other alternative dispute resolution proceedings.
Dale advises clients on a wide range of debtor/creditor disputes, workouts and structured resolutions. Over his career, he has successfully represented clients in complex financial and legal scenarios, achieving favorable outcomes through a combination of assertive advocacy and strategic resolution. His ability to align legal strategies with client objectives ensures comprehensive and effective representation. A particular focus of Dale’s practice has long been complex commercial mortgage and other security interest foreclosures on complicated assets, with attendant bankruptcy issues such as collateral valuation, cram-down plans, and applications for relief from the automatic stay.
Dale also has extensive litigation experience with fiduciary clients, including litigation and liquidating trustees and receivers. This practice encompasses directors’ and officers’ liability litigation involving fraud claims, Ponzi schemes, fiduciary duty breaches, and complex fraudulent transfer claims.
Dale has represented prominent commercial lenders, investment funds, hard money lenders, commercial real estate lenders and developers, and investors in distressed industries, as well as international service and energy companies. His extensive knowledge, practical approach and dedication to excellence have earned him the trust and respect of both peers and clients.
